Terms of Service
Last updated: 20 October 2026
Overview
Welcome to Sea Dog Vest! The terms “we”, “us” and “our” refer to seadogvest based in Perth, Western Australia. We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Sea Dog Vest is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced in them (these “Terms of Service”), describe your rights and responsibilities when you use the Services. Please read them carefully.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services. These Terms of Service do not limit any rights you have under the Australian Consumer Law or any other consumer protection law that cannot be waived.
1. Access and account
By agreeing to these Terms of Service, you confirm that you are at least 18 years old (or the age of majority in your state or territory) and that you consent to any minor dependents using the Services on devices you own or manage. To browse or buy, you may be asked for information such as your email address, billing, payment and delivery details. You confirm that all information you give us is correct, current and complete. You are responsible for keeping your account details secure and for activity on your account. You may not transfer or sell your account to anyone else.
2. Our products
We make every effort to describe and photograph our products accurately. Colours may look slightly different on your screen depending on your device and settings, and sizes are approximate. Please use our size guide and size calculator, and measure your dog before ordering. If you are unsure which size to choose, contact us before you order.
Our vests are flotation aids. They are not life-saving devices and do not guarantee that a dog will stay afloat or be safe in the water. You must always supervise your dog in or near water. Check the fit and the straps before every use, and stop using the product if it is damaged. You are responsible for deciding whether a product suits your dog, including its size, weight, breed and swimming ability.
We may change product descriptions, discontinue products, or limit quantities. None of this limits your rights under the Australian Consumer Law, including your right to goods that match their description.
3. Orders
When you place an order, you are making an offer to buy and you authorise us and our payment processors to charge your chosen payment method for the full amount. Your order is accepted when we confirm it. We may decline or cancel an order for reasons such as stock or pricing errors, suspected fraud, or being unable to deliver to your address. If we cancel an order you have paid for, we will refund you in full.
Please check your order carefully before you submit it. Orders are passed to our supplier quickly, so we may not be able to cancel an order once it has been processed. Contact us as soon as you can if you need a change. Returns and refunds are handled under our Refund and Returns Policy, and this does not limit any rights you have under the law. You confirm that you are buying for your own personal or household use, not for resale.
4. Prices and billing
All prices are in Australian dollars (AUD) and include GST. Delivery within Australia is free. The price charged is the price shown when you place your order and appears in your confirmation email. Prices and promotions may change, but not after you have ordered. Promotions may have their own terms, and if they conflict with these Terms of Service, the promotion terms apply to that promotion. You confirm that you are authorised to use the payment method you provide, that the details are correct, and that you will pay the charges for your order.
5. Shipping and delivery
We deliver to addresses in Australia only. Our products are shipped from overseas by our suppliers. Estimated delivery time is 10-15 business days from the order date. This is an estimate, not a guarantee, and delays can happen because of carriers, customs, weather or other events outside our reasonable control. We will email you tracking details once your order ships. If your order is delayed beyond a reasonable time, contact us and we will help or arrange a remedy where you are entitled to one. Risk in the goods passes to you when they are delivered to the address you gave us. You are responsible for giving us a correct address. Please see our Shipping Policy for more details. Nothing in this section limits your rights under the Australian Consumer Law.
6. Intellectual property
Our Services, including our trademarks, brand, text, images, graphics and video, are owned by us or our licensors and are protected by Australian and international intellectual property laws. Buying a product does not give you any intellectual property rights in the product, its design or our content. You may use the Services for personal, non-commercial purposes only. You must not copy, distribute, modify, republish or otherwise use any material on the Services without our written consent. Shopify’s names and logos belong to Shopify, and all other names and logos belong to their owners. Product reviews on our site may be written by third parties and remain their responsibility.
7. Optional tools
We may give you access to tools provided by third parties as part of the Services. We do not monitor or control them, and they are provided “as is” and “as available”. You use them at your own risk, and you should check the terms of each tool’s provider. Any new features we add to the Services are also covered by these Terms of Service. This section does not limit your rights under the Australian Consumer Law.
8. Third-party links
The Services may contain links to websites run by third parties. We are not responsible for the content, accuracy or practices of those websites. If you leave our site, you do so at your own risk, and you should review the other site’s policies. Complaints about third-party products and services should be directed to that third party.
9. Relationship with Shopify
Sea Dog Vest is powered by Shopify. When you use the Services, your device communicates with Shopify’s systems to deliver them, and Section 10 explains how this information is used. Your purchases are made directly with us, not with Shopify, and Shopify is not a party to your sale.
10. Privacy policy
Our Privacy Policy explains how we collect, use and disclose your personal information. Because our Services are hosted by Shopify, Shopify also collects, uses, processes and stores information about your use of the Services and your transactions, including to provide, secure and improve the Services, process payments and help prevent fraud. Information collected when you visit or use the Services, including browsing activity, may be shared with Shopify and with third parties that may be located outside Australia. Please read our Privacy Policy and Shopify’s Privacy Policy for more detail.
11. Feedback
If you send us ideas, suggestions, reviews or other content (“Feedback”), you give us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display that Feedback in any medium, including for promotion of our Services. You confirm that you own or have the rights to your Feedback, that it is truthful, that you have told us about any payment or incentive you received for it, and that it does not break the law or any third party’s rights. We are not obliged to keep Feedback confidential, pay for it, or respond to it. We may edit or remove Feedback that is unlawful, offensive, misleading or infringes anyone’s rights. You must not use a false email address or pretend to be someone else when sending Feedback.
12. Errors, inaccuracies and omissions
Sometimes information on our Services may contain mistakes or omissions about product descriptions, pricing, promotions, shipping or availability. We may correct errors, update information, or cancel an order if the information was wrong, including after you’ve ordered. If we cancel an order after taking payment, we will refund you in full.
13. Prohibited uses
13.1 You may use the Services for lawful purposes only. You must not use them: (a) for any unlawful or malicious purpose; (b) to break any Commonwealth, state or territory law or regulation; (c) to infringe our intellectual property or anyone else’s; (d) to harass, abuse, defame or threaten any person; (e) to send false or misleading information; (f) to send spam or unsolicited promotional material; (g) to impersonate any person or entity; or (h) to engage in any conduct that restricts or interferes with other people’s use of the Services or that may harm us, Shopify or other users.
13.2 You also agree not to: (a) upload or send viruses or other malicious code; (b) copy, extract, sell or exploit any part of the Services; (c) collect or track other people’s personal information; (d) use bots, scrapers, automated tools or other methods to access the Services, except as allowed in Section 14; or (e) interfere with or bypass the security features of the Services.
14. Agents
14.1 This section applies if you use or allow software or a service that takes autonomous or semi-autonomous action on your behalf (“Agent”) to access or interact with the Services.
14.2 An Agent may only access the Services if it identifies itself and follows Section 14.4, and it must stop if we ask it to.
14.3 We may limit, including by technical measures, whether and how Agents access the Services.
14.4 Agents must: (a) include “Agent/[agent name]” in the user agent string of every request; (b) not hide that they are Agents, including by imitating human behaviour or defeating CAPTCHAs; (c) answer truthfully if asked whether they are a human or a computer; and (d) not get around any measure that blocks, limits or controls Agent access.
15. Termination
We may suspend or end your access to the Services if you breach these Terms of Service, misuse the Services, or if the law requires. Termination does not affect any amounts you owe or any rights you have under the Australian Consumer Law. Provisions that by their nature should continue after termination will continue, including Intellectual property, Feedback, Limitation of liability, Governing law and Privacy policy.
16. Disclaimer of warranties
The information on our Services is for general purposes only. We do not guarantee that it is complete or error-free, and you use it at your own risk.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Subject to those guarantees, and to the extent the law allows, we provide the Services and our products without other warranties, and we do not guarantee that the Services will be uninterrupted, timely, secure or error-free.
17. Limitation of liability
To the extent the law allows, and subject to your rights under the Australian Consumer Law, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, savings or data, whether in contract, tort (including negligence) or otherwise, arising from your use of the Services or our products. We are also not liable for loss caused by misuse of a product, by failing to supervise your dog, or by choosing a size or product that does not suit your dog. Nothing in these Terms of Service excludes or limits any liability that cannot be excluded or limited by law.
18. Indemnification
To the extent the law allows, you agree to cover loss that we reasonably suffer because you breached these Terms of Service, broke the law, or infringed someone’s rights while using the Services. This does not apply to loss we cause ourselves.
19. Severability
If any part of these Terms of Service is found to be unlawful or unenforceable, it will be enforced to the extent the law allows, and the rest of the Terms of Service will remain valid. Nothing in these Terms limits any rights you have under consumer protection law that cannot be waived, and those rights apply if there is a conflict.
20. Waiver; entire agreement
If we do not enforce a right or provision, that is not a waiver of it. These Terms of Service, together with the policies referred to in them, are the whole agreement between you and us about your use of the Services, and replace any earlier versions or arrangements.
21. Assignment
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, for example if we sell the business.
22. Governing law
These Terms of Service are governed by the laws of Western Australia and the Commonwealth of Australia. You and we agree to the non-exclusive jurisdiction of the courts of Western Australia. Nothing in this section limits any right you have to rely on mandatory laws that apply where you live.
23. Translations
These Terms of Service may be available in other languages. If there is any difference, the most current English version applies.
24. Headings
Headings are for convenience only and do not affect the meaning of these Terms.
25. Electronic communications
By using the Services or placing an order, you agree that we may send you service and transaction messages electronically (for example, order confirmations, shipping updates and replies to your questions). We will only send you marketing emails if you have agreed to receive them, and you can unsubscribe at any time. Please keep your contact details up to date.
26. Changes to Terms of Service
You can always find the latest version of these Terms of Service on this page. We may update them by posting changes on our website, and we will tell you about material changes as required by law. The version in place when you place an order applies to that order. By continuing to use the Services after a change takes effect, you accept the updated terms.
